1. Who we are

Futuro Imperfecto, S. de R.L. de C.V. ("Futuro Imperfecto"), trade name Futuro Imperfecto, Idea Builder Studio, is a Mexican company with address at Calle 18B # 251, Mérida, Yucatán, CP 97305, México. Its legal representative is Roman Parra. Contact: info@futuroimperfecto.xyz.

2. Scope and acceptance

These terms govern the use of the website futuroimperfecto.xyz and of the services we provide, including WhatsApp automation services for businesses on the WhatsApp Business Platform. By using the site or our services you accept these terms.

When a business hires a service, the proposal or contract signed with that business also applies, and it prevails over these terms where they differ.

3. Our services

• Project planning and management.
• Web application development.
• WhatsApp automation: assistants, message templates approved by Meta, connection with the business's own systems, and registration and setup of the business's phone number on the WhatsApp Business Platform.

The scope, deliverables, prices and payment terms of each service are set in its proposal or contract.

4. Obligations of businesses that use our WhatsApp services

• Comply with the WhatsApp Business Messaging Policy and Commerce Policy and with Meta's terms for the WhatsApp Business Platform.
• Send messages only to people who have agreed to receive them, and stop writing to anyone who asks.
• Be responsible for the content we send on its behalf and for the accuracy of the information it gives us.
• Inform its customers how it processes their data, through its own privacy notice. We process that data on its behalf, as described in section 4 of our Privacy Notice.
• Not use the services to send spam or unlawful content, or to offer goods and services that WhatsApp policies prohibit.

5. Third-party platforms

Our WhatsApp services run on Meta's WhatsApp Business Platform and on the providers listed in our Privacy Notice. Their availability, rules and fees are set by them. Meta may limit or suspend a business account or phone number that breaches its policies, and Meta's messaging fees are separate from our fees unless the contract says otherwise.

6. Use of this website

Do not use this site or its contact form for unlawful purposes, to send spam, to try to access our systems without authorization, or to interfere with their operation.

7. Intellectual property

The content of this site and the Futuro Imperfecto name and logo belong to Futuro Imperfecto. Ownership of the work we build for a client is set in that client's contract. Each business keeps ownership of its data and of the content it gives us.

8. Personal data

We process personal data as described in our Privacy Notice. To request the deletion of your data, follow the steps in its Data deletion section.

9. Availability and liability

We take reasonable measures to keep this site and our services available and secure, but we do not guarantee uninterrupted operation. To the extent permitted by Mexican law, we are not liable for indirect damages, for failures of third-party platforms, or for a business's use of the services in breach of these terms.

10. Suspension and termination

We may suspend or end a service if the business breaches these terms, WhatsApp policies or the law, or if Meta requires it. Any other termination conditions are those set in the contract.

11. Changes to these terms

We will publish any change to these terms on this page, with its update date. Using the site or our services after a change means you accept the new terms.

12. Governing law and jurisdiction

These terms are governed by the laws of Mexico. Any dispute will be resolved by the competent courts of Mérida, Yucatán, México.
